Full time and part time (pro rata) staff are entitled to annual leave in accordance with the relevant Award within which they have been employed.
Annual Leave entitlements are not applicable to casual staff. Salary compensation for annual leave is built into the casual rate paid. These workers are urged to take adequate annual leave for the sake of their health and wellbeing, particularly those with heavy workloads.
Lalor Street Day Activities closure dates will be advised before the commencement of each calendar year. Staff may take additional leave at a time of their choice but this must be negotiated with the Day Activities Coordinator as it entails backfilling the worker’s position.
Windward Industries and Seawinds Nursery
Kyeema Businesses Seawinds Nursery, Windward Industries and Green Fingers Gardening operate for most of the year, with time out over Christmas, New Year and Easter. Annual leave is by arrangement with the Manager.
In-home, Community and Accommodation services
Many participant supports continue through holiday periods, including assistance with daily living, Short Term Accommodation and Supported Independent Living.
Annual leave periods for these programs is to be negotiated with the Supports Managers or Team Leader and staff will be required to complete an Annual Leave Form and submit to the Supports Manager or Team Leader for consideration.
Casual staff are requested to do the same so support of participants can continue in a planned manner.
• Unpaid leave is by arrangement with the Manager of the worker’s area of work.
• Where available, an employee’s accrued leave (such as annual leave, personal leave and long service leave– if appropriate) will be utilised before unpaid leave is considered.
• Where an employee takes unpaid leave, other leave entitlements will cease to accrue for the period of that unpaid leave.
Excessive Accrued Annual Leave
The Fair Work Commission allows an employer to direct an employee to take paid annual leave if:
A. the employee has accrued at least six (6) weeks of annual leave;
B. the employer gives the employee four (4) weeks’ notice to take the annual leave; and
C. the employee retains at least four (4) weeks of accrued annual leave after the direction is given by the employer.
