Conflict of Interest Policy - Workers

Human Resources Conflict of Interest Policy - Workers

Authorised by Chief Executive Officer

Revised Date: 6 July 2024

Policy

The NDIS is designed to support people to pursue their own goals and to build their capacity to lead a meaningful life.

Kyeema Support Services Inc. (Kyeema) acknowledges that participant choice and self-determination are the overriding philosophies underpinning the NDIS.

Kyeema recognises that the existence of a conflict of interest is not uncommon and what matters is how Kyeema manages that conflict.

Kyeema is committed to ensuring that conflicts of interest are identified and managed so that they do not affect the services, activities or decisions of the organisation, or its participants.

As an NDIS Registered Provider, Kyeema is required to:

•   enable participants to make informed choices;

•   ensure that its organisational or ethical values do not impede a participant’s right to choice and control;

•   ensure that it does not direct or influence a participant’s choices;

•   ensure that advice to a participant about support options (including those not delivered directly by the provider) is transparent and promotes choice and control;

•   manage, document and report on individual conflicts as they arise; and

•   put the interest of the participant first.

Conflict of Interest is an action, position or interest that conflicts or appears to conflict with an interest of Kyeema’s. This can be actual, potential or perceived.

Procedure

Kyeema workers are to always identify to NDIS participants that:

•   Kyeema offers support coordination as well as a wide range of other supports under the NDIS

•   the participant in the NDIS always has the choice to use either Kyeema or other service providers in relation to plan management, support coordination and/or other supports

•   Kyeema will offer supports to NDIS participants regardless of whether they self-manage their plan, use the NDIS or any other registered plan manager.

•   Kyeema workers will manage conflicts of interest as they arise in line with NDIS operational guidelines or pricing arrangements.

•   Kyeema workers will notify their manager of any conflicts as they arise as well as document the conflict.

Participants are able to raise complaints using our Complaints and Compliments Management Policy.

Kyeema workers are required to adhere to the Code of Conduct - Workers to manage real or perceived conflicts of interest, and to record and report any which may be identified.

Managers are to complete the Annual Declaration of Interest by Management form HRF-73 annually

This policy will be reviewed triennially by Kyeema workers.
