Purpose
To provide guidance for the circumstances under which a participant’s behaviour may bring about a suspension or termination of services by Kyeema.
Participant rights and principles of natural justice should underpin any such decision. The rights of participants and staff to a safe environment are a consideration.
Suspension or Termination of Support
Suspension or termination of service may be considered if a participant has behaviours of concern that are a threat to other participants and/or staff. This can include assault, threat to assault, criminal activity or persistent property damage.
The decision to suspend or terminate service will be a fair and transparent process and may be undertaken where it is deemed an urgent safety risk or where it has been recommended by an external authority or expert.
Refusal to Access Planned Services
Participants have a choice as to whether they receive support from Kyeema and have the right to refuse this. If a participant communicates for an extended period of time that they do not wish to access the services, their service may be suspended pending a decision by the individual and/or nominee. This will save their funding
Documentation
Any process towards suspension or termination must be well documented. This would include meeting notes, case management notes and shift notes.
Appeal Process
Should the participant, parent or carer be aggrieved by the process or outcome the opportunity to appeal the decision will be made available.
The participant, parent or carer may request the organisation reconsider the decision.
The Chief Executive Officer will make a final decision. The participant, parent or carer will be advised of other avenues of appeal including the Complaints Procedure.
