Time in Lieu (TIL), which is sometimes called Time off in Lieu (TOIL) is an agreement between an employee and an employer to take time off instead of payment for overtime the employee has worked.

 

Pricing arrangements with the NDIS do not fund payment of any overtime so this can be a mutually agreeable arrangement.

 

A standard working fortnight consists of 76 hours. Time worked in excess of this constitutes a time in lieu credit to be carried forward to the next fortnight (or longer by arrangement) at ordinary rate only.

 

It is important for a variety of reasons that Kyeema staff limit the TIL accrued:

 

-    It may be an indication the employee is overworked in which case, for safety and wellbeing reasons, a strategy needs to be considered as to how to resolve this

-    It is not in Kyeema’s best interests financially to carry the liability of unused TIL

 

Circumstances where TIL may be accrued include out-of-town events where workers are on duty for longer hours than they usually would be. In this situation the arrangements for accruing and using the TIL credit may be agreed before the worker accepts the shifts.

 

Where an employee has accrued TIL while undertaking higher duties, the accrued TIL will be paid at the agreed upon higher duties rate.

 

Procedure - All Staff

The maximum time in lieu to be carried over into the following fortnight is 10 hours. Time in Lieu is required to be used by the 30th of June of the year the time in lieu was accrued. Additional time in lieu can be carried over if previously agreed upon with management.

 

Accumulation of time in lieu and instances time in lieu credits have been accessed must be recorded on time sheets.

 

Time in lieu should be taken at a time mutually agreed between the employee and Kyeema, subject to the operational requirements of the programs and shifts.

 

According to our Enterprise Agreement separate agreements to take overtime as Time in Lieu need to be entered into. This can be simply a signed request form HRF-35.

 

Consistent with flexible work practices and the awareness of the importance of health and wellbeing, these arrangements can be used to support staff to balance work and family life.

 

TIL is not transferrable between staff.
